Terms
Terms and conditions of use
Last updated: October 8, 2026
These terms govern the use of the Mowak Games website and of our Mowak Games digital pinball machine, including its software. By using the website or the pinball machine you accept them, so please read them carefully, especially the section on tables and games from external sources.
In short
- The pinball machine is a wall-mounted piece of furniture that folds down to play: only an adult with enough strength and height to do it safely should open, close or lock it, with no one underneath it or within 2 meters, and when closed it must always stay locked.
- You install it on the wall yourself, following at least our installation manual, and it must be firm and secure so that the pinball machine cannot come loose or fall.
- Inside, the Mowak Games pinball machine is a computer, so an advanced user could install and run applications, games or tables that do not come from Mowak Games, or even replace its operating system. We neither offer nor support this, and we cannot prevent or control it.
- Installing that content is your decision and your responsibility. We do not review, endorse or distribute it.
- We respect the work of authors: only use tables, games and files you have the right to use. Using content that does not respect those rights is your sole responsibility.
- Many third-party tables and games are shared for personal use only: using them in a venue open to the public or charging to play them requires their authors' permission, and getting it is your responsibility.
- External files, and the USB drives or shared folders you use to copy them, can carry security risks, such as viruses or other malicious software that affect the pinball machine or other devices on your network. Protecting yourself against that is your responsibility.
- We cannot guarantee that every table will work, or that it will keep working after an update.
- Preinstalled software does not mean everything is included or free: you use your own account with each provider, and some third-party games, extra tables and features may require additional purchases. We never share third-party accounts.
- Published prices may vary over time and, since they are the same for every country, do not include taxes or shipping, which depend on the destination.
- Problems caused by external content may fall outside our support and warranty.
- If you modify the pinball machine, connect devices other than the ones included, or change its operating system or settings, we cannot guarantee it will work properly, and the problems this causes may fall outside our support and warranty.
1. Scope
These terms apply to the website mowakgames.com and to the Mowak Games pinball machine, the software it runs and the content we supply with it. Some purchases may come with their own sales, warranty or shipping conditions; if so, those conditions also apply and take precedence on the matters they cover.
2. Use of the website
- Use the website lawfully and give us truthful information in our forms.
- Do not try to disrupt the website, access it by automated means to abuse it, or get around its security measures.
- Joining the pinball waitlist is not a purchase or a reservation. It only lets us tell you about the launch and availability.
- Photos, videos and specifications shown on the website are for reference and may change while the product is being developed.
3. Prices, payments, taxes and shipping
We do our best to keep the prices we publish, but we cannot guarantee that they will not vary over time. The cost of electronic components, especially processors and memory, has risen significantly worldwide, and that directly affects what it costs to manufacture our pinball machines. Those variations may lead to a difference in the final price. The price that applies to each purchase is the one stated in its purchase order.
We sell to customers in different countries, and taxes and shipping costs depend on where the pinball machine is bought from and where it is sent: country, state or region. To avoid confusion, the prices we publish are the same for everyone and do not include taxes (such as state or local taxes, or import taxes and duties on international purchases) or freight and shipping costs.
When you enter the destination during the purchase, we will estimate those costs and give you the details before you complete it. Unless the purchase order says otherwise, taxes, duties and shipping costs are the customer's responsibility.
Online sales are made by Mowak Games, and payments are processed by Stripe. You enter your card details directly with Stripe, so we do not receive or store them.
4. The Mowak Games pinball machine and its software
The Mowak Games software included in the pinball machine is licensed to you for use on that machine. You may not copy it, distribute it or modify it. We may release updates to fix problems, improve security or add features, and some of them may be needed to keep receiving support.
Third-party software we preinstall
We only preinstall third-party software, such as game platforms or commercial pinball games, when its provider's license or a written authorization from the provider allows us to. When we do, the product description or the purchase order identifies that software and states what, if anything, is included with it. It still belongs to its developers and remains subject to their own terms, privacy policies and technical requirements.
Having an application or platform preinstalled does not mean that its games, tables, downloadable content or subscriptions are included or free:
- Unless the product description or the purchase order expressly says otherwise, you must create and use your own account with each provider, and get any licenses, purchases or subscriptions you need directly from them.
- Some games only include a base version, and additional tables, games or features are sold separately as downloadable content (DLC) or in-app purchases.
- Those purchases are made directly with each provider, at its prices and under its conditions, and are the customer's responsibility.
- Some licenses only allow personal or home use, and using that software in a business or a place open to the public may require a different license. See Commercial and public use.
Mowak Games does not provide, transfer or share third-party accounts or their credentials.
The price of the pinball machine only includes the software, content and licenses that the purchase order or product description expressly states as included. Mowak Games may also offer additional games, content or features separately, at an additional cost.
5. Physical safety: installation, opening, closing and locking
The Mowak Games pinball machine is a piece of furniture that is mounted on the wall and folds down to play, with its own mechanism to open, close and lock it. Both installing and using it require following the measures in this section.
Wall installation
The customer installs the pinball machine on the wall. It must be installed, at a minimum, according to our standards and the instructions in our installation manual, on a wall able to bear the weight of the pinball machine and the effort of opening and closing it. Whoever installs it is responsible for making sure it is firm and secure and cannot come loose from the wall or fall unintentionally. A faulty installation could cause harm to people, objects, nearby furniture, the wall or the surroundings, as well as to the pinball machine itself. If you are not sure you can install it safely, use a qualified person.
Opening, closing and locking
The pinball machine is designed to be operated by an adult with enough strength and height to open, close and lock it safely and without difficulty, bearing in mind that the lock is at the top. To prevent accidents, always follow these measures:
- Only an adult with enough strength and height to control the mechanism and reach the lock safely and without difficulty should open, close or lock the pinball machine.
- Do not stand on a stool, chair, ladder or any other object to reach the lock or the mechanism. If you cannot reach it standing on the floor, ask another adult who can to do it.
- No one should be underneath the pinball machine while it is being opened, closed, locked or played.
- While it is being opened, closed or locked, no one else should be within 2 meters of the pinball machine, especially children or short people.
- When it is closed, always keep it locked, to prevent it from opening unintentionally.
These measures are required to install and use the pinball machine and its opening, closing and locking mechanism safely. To the extent the law allows, Mowak Games is not liable for accidents or damage that occur because they were not followed, including those caused by an installation that does not comply with our installation manual.
6. Tables and games from external sources
Inside, the Mowak Games pinball machine is a computer. As with any computer, an advanced user could install and run on it applications, games, tables and related files that are not supplied by Mowak Games, together with the images, videos, animations, music, sounds or add-ons they include, and could even replace its operating system (see Modifications to the pinball machine). This is not a feature we offer or support, and we cannot prevent or control it: it is simply possible because of how a computer works. We call all of this external content, whatever its origin:
- Downloaded from websites, forums or online communities.
- Created or modified by you.
- Received from other people or obtained from any other source.
It also does not matter how it reaches the machine: a USB drive, a shared network folder or any other method.
No relationship with those sources
Mowak Games is not affiliated with those communities, sites or table authors, and we do not review, endorse, host or distribute their content, nor verify whether it is licensed, compatible or safe. Mentioning a site on this page, or showing a community table in our photos and videos, does not mean it is an official or recommended source, nor that the table is included with the pinball machine, unless we say so explicitly.
Your responsibility
Installing external content is your decision. By doing so, you are responsible for:
- Getting it from sources you trust and checking what you install.
- Having the right to use it: respecting the licenses set by its authors and the rights over the brands, artwork, music, software or any other material it contains.
- The consequences that installing or running it may have on the pinball machine, on your data or on your network.
Commercial and public use
Many tables and games, especially those shared in the community, are offered for personal, non-commercial use only. The same goes for the licenses of many third-party games and programs, which may distinguish between home and commercial use. Being able to download or use content for free at home does not mean you may use it in a business or charge for it.
If you use external content or third-party software in a place open to the public, such as a bar, restaurant, arcade or event, or if you charge to play it with tokens, credits or in any other way, that use is yours and you alone are responsible for:
- Having the licenses or authorizations that use requires for everything the content includes: the table or game itself, as well as its artwork, brands, music or any other third-party material.
- Complying with the permits, taxes and rules that apply where you use it.
To the extent the law allows, you agree to indemnify and hold Mowak Games harmless from third-party claims arising from the external content or third-party software you use, or from the commercial or public use you make of it.
Security
Many applications, games and tables include programs or code that run on the machine. A file from an unknown or unreliable source may contain viruses or other malicious software (malware) that damages the pinball machine's software, affects your data or spreads to other computers and devices connected to the same network as the machine.
The medium you use to copy files is also a risk: a USB drive or shared folder may be infected or carry files other than the ones you meant to copy, even if they have nothing to do with a table.
Checking what you connect and protecting your network is your responsibility. To the extent the law allows, Mowak Games is not liable for damage caused by malicious software that reaches the machine through external content, USB drives, shared folders or any other medium you connect.
Compatibility
We cannot guarantee that an external table will work correctly. It may not open, may run slowly, freeze, look wrong on the pinball machine's screen or not respond properly to its buttons and controls.
A table that works today may stop working after a software update.
Support and warranty
Our support covers the Mowak Games pinball machine and its software as we supply them. Faults or damage caused by external content may fall outside the warranty and technical support, to the extent the law allows. To diagnose a problem we may ask you to remove external content or to restore the software to its factory state, which may delete the tables and settings you installed. We do not commit to adapting or fixing external tables.
Good practices
- Download only from sources you know and that have an active community.
- Scan files with an antivirus on your computer before copying them to the pinball machine.
- Do not connect USB drives of unknown origin to the pinball machine.
- Use a USB drive or folder dedicated to the pinball machine, containing only the files you want to install.
- Keep your own backup copy of the tables and settings you care about.
- If the pinball machine starts behaving strangely after installing something, remove it and contact us.
7. Modifications to the pinball machine
We design, configure and test the Mowak Games pinball machine as a whole: its hardware, accessories, operating system and software. That is why we can only guarantee how it works as we deliver it from the factory.
Hardware and external devices
If you modify the pinball machine or connect devices that we did not supply, we cannot guarantee that it will work correctly or that no faults will occur. This includes, for example:
- Connecting USB devices or other peripherals other than the ones included, such as controllers, keyboards, drives, adapters or hubs, beyond the normal use of a USB drive to copy files (see its risks under Security).
- Replacing the screens, buttons, speakers, power supply or any other component or accessory.
- Opening the cabinet to add, remove or alter parts, cables or connections.
Operating system and settings
The same applies if you modify the pinball machine's operating system or software, or change its settings beyond the options we provide: for example, installing drivers or system software, changing settings that are not available in our menus, disabling updates or security features, or replacing the operating system.
Since the pinball machine is built on a computer, we cannot prevent or control these changes. But whoever makes them does so at their own risk: from that point the machine no longer matches the product we design, test and support, and we may no longer be able to provide the software, updates, features or content that depend on it.
Support and warranty
Faults or damage caused by modifications to the pinball machine's hardware, operating system or settings, or by devices we did not supply, may fall outside the warranty and technical support, to the extent the law allows, and we may not be able to help with problems that stem from them. To diagnose a problem we may ask you to disconnect external devices, return the machine to its original configuration or restore the software to its factory state, which may delete the settings and content you installed.
8. Intellectual property
Third-party brands, names and works mentioned on the website or appearing in external content belong to their respective owners. We take copyright seriously, including that of third parties; see how it applies to external content in Respect for authors and intellectual property.
9. Warranties and liability
We work to keep the website available and the pinball machine working properly, but we cannot promise that the website will always be available or free of errors. To the extent the law allows, Mowak Games is not liable for damage arising from external content, from modifications to the pinball machine that we did not make, from using the pinball machine in ways other than intended or without following its safety measures, or from causes beyond our reasonable control.
10. Links to other sites
The website may link to third-party sites, such as social networks or pinball communities. We do not control those sites and are not responsible for their content, security or policies.
11. Privacy
How we handle personal data and the data the pinball machine sends is explained in our privacy policy.
12. Changes to these terms
We may update these terms when our products or the law change. We will always publish the current version on this page with its update date and, if the change is significant, we will let you know through our usual channels.
13. Who we are and contact
